Any legal experts out there? As I understand it in your home you can record anything you want with out consent. But what about a co-worker baiting and recording a conversation only to play it back to a supervisor? Is it legal to record a conversation without the other party knowing?

South Carolina is a one-party-consent state with regard to telephone conversations, as I recall. Only one party in the conversation (generally the one doing the recording) is required to give consent.

I am not a legal expert and this information did not come from a chain email. That's close enough, right?

I'm more interested in hearing what your coworker baited you into admitting on tape.

Not an expert, but i would assume that anything i said at my place of employment was assumed to be privy to management or supervisors by whatever means available. If you suspect you are on the "getting set up" side of this equation, you should err on the side of caution.

And while erring on the side of caution i might accidentally start a rumor about how my adversary enjoys attempting to procreate with roadkill while screaming my bosses wife's name...

Capntang is on the mark. SC does not have a specific statute, and when the issue has been raised, the SC and 4th Circuit courts have held to the one party consent rule.

The more we just complain...the more things stay the same.

Not worried about being set up, but was asked to listen to a recorded conversation from one of my "cheese eaters" trying to gain some brownie points. I got some amusement out of it, but at the same time it ticked me off that we have co-workers against each other. Hard to build a good team when you have a couple of weasels in the mix. Paper work trail is started on him.

might want to check your companies policies as well. Might be against policy to even have a recording device in the workplace.

Joe boo...and if they will record them they would record you too it seems....
Doesn't seem it would be appropriate or legal....many companies you call now even have a recording that say...this call may be recorded and monitored for......that to me would seem to mean they have to disclose that....
Sounds like this coworker may be a trouble maker?...

Yes, mam. A trouble maker. I'm working with HR now. If he would have stolen from the company it would be easy. We are working the coming in late thing.

Large call centers often serve much more than just one state, and recording laws vary from state to state. That sounds mostly like a catch-all to satisfy legal requirements in places where all involved parties must be notified when a conversation is being recorded.

For conversations taking place entirely within SC, only one party needs to be aware of the recording.

It's a good thing, too. I'm pretty sure you haven't been aware that I've been recording all of our previous phone conversations to gather blackmail material, but that's OK since I knew they were being recorded.
